| The fatwa and the fatwa-giver (the mufti)
A fatwa informs about the Shareeah ruling but in a non-binding manner. Giving a fatwa is a very serious matter and a lofty position. The mufti is essentially signing on behalf of Allah. He is performing the same role for the Muslim Nation as the Prophet (peace and blessings of Allah be upon him) did in explaining the laws of the Shareeah. The goal of the fatwa and the seeking of a fatwa is to take the legally responsible individual from the realm of following desires and whims to that of being a true servant of his Lord. |
حول الفتيا والمفتي الفتوى: إخبار عن حكم شرعي على غير وجه الإلزام. الإفتاء عظيم الشأن، كبير الموقع، والمفتي موقع عن الله تعالى، وقائم في الأمة مقام النبي صلى الله عليه وسلم في بيان أحكام الشريعة، وغاية الفتيا والاستفتاء إخراج المكلف عن داعية هواه حتى يكون عبدًا لمولاه. |
| A person is not qualified to give fatwas until he possesses the prerequisites of fatwa-making. These include knowledge of the Book of Allah and its related sciences, knowledge of the Sunnah of the Messenger of Allah (peace and blessings of Allah be upon him) and the ability to distinguish the sound from the weak reports, knowledge of Islamic Legal theory with its maxims and goals, and knowledge of Arabic. The person must have insight into the current circumstances and familiar with the differences of opinion among the jurists. He must be specialized in Islamic Law and Jurisprudence, either through experience or by graduating from a specialized college. |
لا يكون المفتي أهلا للإفتاء إلا إذا تحققت فيه شروط الإفتاء من معرفة بكتاب الله تعالى وعلومه، ومعرفة بسنة رسول الله صلى الله عليه وسلم والقدرة على تمييز صحيحها من ضعيفها، ومعرفة بأصول الفقه وقواعده ومقاصده، ومعرفة بعلوم اللغة العربية، وأن يكون بصيرا بالواقع عارفا باختلاف الفقهاء، وأن يكون مختصاً بالشريعة والفقه، إما ممارسة، أو بالتخرج في كلية مختصة. |
| Unless fatwa becomes binding on a specific mufti, he may refer the issue to others. He may be driven to do this out of caution and fear of Allah, because he cannot see what is the correct view, because he does not have the time to research it, in order to make the conclusion easier on the one seeking the fatwa, or for the sake of the benefit of the community and bringing the hearts together. |
للمفتي إذا لم يتعين للفتيا أن يحيل الأمر على غيره، تورعا واحتياطا، أو لخفاء وجه الصواب، أو لضيق الوقت، أو تيسيرا على المستفتي، أو رعاية لمصلحة الجماعة والائتلاف. |
| The default is that a mujtahid (fully qualified scholar) should give the fatwa. If that is not possible, then it should be handed over to others in order of their qualifications. If it is known that a person is ignorant or immoral and if a person’s state is not known, then one should not turn to such a person for a fatwa. |
الأصل أن تناط الفتوى بالمجتهدين، فإن عدموا اعتبر الأمثل فالأمثل من غيرهم، ومن علم جهله أو فسقه أو جهل حاله لا ينبغي استفتاؤه |
| A non-qualified person giving a fatwa is one of the greatest abominations against Allah and His Messenger. It is from the great sins and a crime against the religion, in this world and the Hereafter. |
الإفتاء من غير أهله من أعظم الفرية على الله ورسوله، وهو من الكبائر والجنايات على الدين والدنيا والآخرة. |
| The Manners of the One Seeking a FatwaFirst, he or she should have a sincere intention to seek the truth.
Second, he or she should present their question in a good fashion, not so concise that it is missing important points nor unnecessarily long. He should explain the matter clearly to the mufti if it is difficult for him to conceive the issue. Third, he or she should behave kindly during the conversation, listening attentively, not cutting off the mufti, not burdening the mufti if he declines to answer and avoiding false disputation. Fourth, he or she should choose the most appropriate time, place and setting to ask for a fatwa. Fifth, he or she should have good manners and etiquette with the mufti. |

| The Methodology behind giving a fatwa and its ParametersThe mufti must understand the reality of the situation and details and also be familiar with its circumstances. He or she should seek all the necessary details and seek the help of specialists in relevant fields in order to make a fatwa. |
حول منهجية الإفتاء وضوابطه : فهم الواقعة فهماً دقيقاً، ومعرفة ما يحيط بها، والاستفصال عن جوانبها، والاستعانة بأهل الخبرة والاختصاص عند الاقتضاء |
| The mufti must be careful in giving a fatwa and protect himself from the influence of desires or group partisanship or bigotry. |
التثبت في الفتيا، وصيانتها من التأثر بالأهواء، أو العصبية الحزبية والتنظيمية. |
| The mufti must abide by any issue concerning which there is an established clear consensus. |
الوقوف عند ما انعقد عليه إجماع صريح. |
| The mufti must follow the strongest view—thus blocking the means to follow what he simply likes or desires and making his ruling subjective. |
العمل بالراجح، قطعا للذريعة إلى أخذ الدين بالهوى التشهي، وخرم الانضباط في الأحكام |
| There is an exemption for following a weaker opinion if that is done to repel a harm or difficulty or to achieve a benefit of union and solidarity. This is true regardless of whether the weaker opinion is easier or harsher than the stronger opinion. This can be done as long as this weaker opinion does not contradict clear evidence from the Quran or Sunnah. Additionally, the attribution of this opinion to its originating mujtahid must be through sound chains. The mufti making such a decision must be one capable of measuring between necessities and needs. The mufti must also restrict this fatwa to the particular case at hand. |
يرخص في العمل بالمرجوح دفعا لمضرة أو حرج، أو تحقيقا لمصلحة الائتلاف والاجتماع، سواء أكان القول المرجوح هو الأيسر أم هو الأشد، إذا لم يخالف دليلا صريحا من الكتاب والسنة، وثبتت نسبته إلى قائله من المجتهدين بطريق صحيح، وكان الناظر في ذلك متمكنا من تقدير الضرورات والحاجات، مع اقتصار الفتيا به على النازلة محل الاستفتاء. |
| The mufti should concisely state the Shareeah evidences if possible. He should present the reasoning behind the decision if there are multiple possible views or if there is a conflict in views. |
بيان الدليل الشرعي للفتوى بإيجاز ما أمكن، وعرض التعليل عند تعدد الأقوال، أو التعارض. |
| An authentic hadith that is definitive in its indication and not countered [by another textual proof] may never be rejected in favor of anybody’s view when it has been ascertained that the hadith is sound and there are no strong evidences in conflict with it. This is not an arena for the masses and the like to venture into it. |
الحديث الصحيح القطعي الدلالة الذي لا معارض له، لا يجوز ردُّه بقول أحد الناس، عند التحقق من صحة الحديث ومن عدم المعارض، ولا مدخل في ذلك للعامة وأشباه العامة. |
| The mufti should present an alternative for a prohibited act if so feasible, so that the matter is not closed off for the one seeking the fatwa. |
إيجاد البديل للأمور الممنوعة، أو المحرمة متى تيسرت، حتى لا تغلق الأبواب أمام المستفتين. |
| The mufti must adhere to the fundamental principles of giving a fatwa. In addition to the preceding, this includes: taking into consideration the prevalent customs; not resorting to legal stratagems, especially in those matters that afflict the masses as a whole; following exemptions when the conditions calling for them are present; taking into consideration the necessities and needs of the era that are not in contradiction to the texts or consensus; taking into consideration the new and changing interests of the people; not restricting oneself to one particular madhhab (school of fiqh) on every occasion; seeking, if possible, group fatwas in the general and contemporary issues; verifying that hardships that demand ease are real; giving precedence to ease over being cautious; leading the masses towards the middle positions of the people of knowledge; avoiding the errant anomalous views and notorious strange views; be firmly rooted in the agreed-upon or relied-upon principles of applied fiqh of the majority of the scholars and legal theorists, such as the fiqh of maqaasid (recognizing the goals of the law), the fiqh of tahqeeq al-manaat (verifying that the purpose of the law is being met), the fiqh of weighing between priorities, the fiqh of understanding the long-run consequences of an act, the fiqh of exceptions, the fiqh of graduation, the fiqh of the constants and variables, and so on; follow the moderate, agreed-upon methodology of the majority of the scholars concerning all of the above issues. |
مراعاة الضوابط الأساسية في الفتوى، وهي بالإضافة إلى ما سبق مراعاة الأعراف، وعدم التحايل في الفتوى لا سيما فيما تعم به البلوى، والأخذ بالرخص عند توفر موجباتها، ومراعاة ضرورات العصر وحاجاته بما لا يخالف نصا او إجماعا، واعتبار مصالح الناس المتجددة والمتغيرة، وعدم التقيد بمذهب واحد في جميع الأحوال، والحرص على جماعية الفتوى في القضايا العامة والمعاصرة ما أمكن، والتحقق من حصول المشقة التي تستدعي التيسير، وتقديم الايسر على الأحوط، وحمل العوام على المعهود الوسط من أقوال أهل العلم، وتجنب الشواذ والمشتهرات من غرائب الأقوال، وتأصيل أنواع فقه التطبيق المتفق عليها أو المعتمدة عند جمهور الفقهاء والأصوليين، كفقه المقاصد، وفقه تحقيق المناط (تنزيل النص على الواقع) وفقه الموازنات، وفقه المآلات، وفقه المستثنيات، وفقه التدرج، وفقه الثوابت والمتغيرات، ونحوه، واعتماد المنهج الوسطي المتفق عليه عند عامة الفقهاء في ذلك كله. |
| Differences of opinion among the jurists in and of itself is not a blameworthy matter. It is part of Allah’s magnanimity upon this Nation. In a cosmic sense, there is no way to remove it. In fact, in a Shareeah sense, there is no call to remove it. Some differences though are acceptable and others are not. Even from among the acceptable differences of opinion, some are strong and others weak. What one must avoid is the zealous attachment to one view and the wrongfull attack of those who hold opposing views. |
اختلاف الفقهاء في حد ذاته ليس مذموما، بل هو من توسعة الله تعالى على الأمة، ولا سبيل لرفعه قدرا، وليس مطلوبا رفعه شرعا، ومنه ما هو معتبر وغير معتبر، ومن المعتبر ما هو قوي وضعيف، والمحذور فيه هو التعصب والبغي على المخالف. |
| The Concept of Ijtihâd (Juristic Reasoning), Its Realm and Its PrerequisitesIjtihâd refers to a jurist exerting himself to determine a Shareeah ruling. |
حول الاجتهاد ومواضعه وما يلزم لتحصيل رتبته الاجتهاد هو استفراغ الفقيه الوسع لتحصيل حكم شرعي |
| The realm of ijtihad are all those issues concerning which there is no definitive evidence from an authentic text or clear consensus. There is no sin upon the mujtahid concerning these issues, even if he or she were mistaken. The mistakes that are forgiven for the mujtahid include those made with respect to both creed and practice. |
مواضع الاجتهاد كل ما لم يرد فيه دليل قاطع من نص صحيح أو إجماع صريح، ولا إثم على المجتهد في هذه المسائل وإن أخطأ، والخطأ المغفور في الاجتهاد يتناول الأمور العلمية والأمور العملية |
| The ijtihad that is considered acceptable from a Shareeah perspective is that which has come from one who is qualified to make ijtihad and who has followed the proper steps. The slips and mistakes of a scholar are not to be taken into consideration. The scholar’s honor should not be compromised as a result of it, in order to protect the Shareeah and its bearers. The standard for an [anomalous] mistake is a view that a scholar holds that no one accepts and follows. |
الاجتهاد المعتبر شرعًا هو الصادر من أهله وعلى وجهه، وزلة العالم لا يُعتد بها، ولا تهدر حرمته بسببها، محافظة على الشريعة وعلى حملتها، ومعيارها ما انفرد به أحد من أهل العلم، ولم يتابعه على ذلك أحد. |
| To make ijtihad, it is sufficient for an individual to meet the minimum requirements of ijtihad, such as knowing Arabic, the texts pertaining to rulings of the Quran and Sunnah, principles of analogy, principles of deriving laws from the texts, and issues related to abrogation. The mufti must also make certain that he does not give an opinion on an issue that actually violates consensus. |
يكفي لتحصيل رتبة الاجتهاد تحصيل الحد الأدنى من شروطه، كمعرفة العربية ومعرفة نصوص الأحكام من الكتاب والسنة، ومعرفة القياس، وقواعد الاستنباط، والناسخ والمنسوخ، وألا يفتي في مسألة حتى يستيقن أنه لا يخالف إجماعا. |
| According to the strongest view, it is conceivable for a person to be a mujtahid on only specific issues (divisibility of ijtihâd). It is not necessary for a mujtahid in a certain area of fiqh to be qualified for ijtihâd in all matters of fiqh. | يجوز تجزؤ الاجتهاد في الأرجح، ولا يلزم للاجتهاد في باب أن يبلغ رتبة الاجتهاد في جيمع الأبواب. |
| When there is a pressing need for a fatwa but there is an absence of mujtahids, it is permissible for a follower (non-mujtahid) to pass on an opinion that he has learned of the fatwas of the scholars, if he or she understands it properly and if he or she understands its conditions and parameters. |
إذا عدم المجتهدون واحتاج الناس إلى من يفتيهم جاز للمقلد أن ينقل ما حفظه من الفتاوى إذا فهمها، وفهم شروطها وضوابطها |
| Weighing between opinions based on ijtihâd is a relative matter. What may be considered stronger by one jurist may be considered weaker by the other schools of fiqh or the other muftis. |
الترجيح في المسائل الاجتهادية نسبي، فما ترجح لدى فقيه قد لا يكون راجحا في بقية المذاهب، أو عند بقية المفتين |
| According to the strongest view, it is not sanctioned for a mujtahid to blindly follow somebody else when that opinion goes contrary to what his own ijtihad concludes unless he is doing it to ward off some hardship or to meet the needs and interests of the community and for the sake of unity. |
الأرجح عدم مشروعية تقليد المجتهد لغيره، في خلاف ما أداه إليه اجتهاده، إلا دفعا لحرج، أو رعاية لمصلحة الجماعة والائتلاف. |
| The default is that one should not rebuke those who hold opposing views when it comes to matters of ijtihâd. One should not castigate the faith or trustworthiness of those who hold opposing ijtihâd. At the same time, this does not mean that there should not be mutual inquiry into such issues in order to clarify them based on the proofs and evidences. Not every issue in which there is a difference of opinion is an issue that is actually open to ijtihad. There are some differing views that are incorrect anomalies and not to be considered acceptable views. Of course, determining which opinions fall into that category is left to the scholars. |
الأصل عدم الإنكار على المخالف في المسائل الاجتهادية، فلا يقدح بها في إيمان المخالف ولا في أمانته، ولا يتنافى هذا مع تدارس هذه المسائل، وتحقيقها بالبينات والحجج العلمية، وليس كل مسألة خلافية مسألة اجتهادية، لأن من الخلاف ما يكون شاذا وغير معتبر، ولكن تقدير ذلك مرده إلى العلماء |
| It is not proper to present the varying views of the scholars to the one seeking a fatwa without also stating which is stronger, as the one seeking the fatwa may get the impression from this approach that the matter is permissible. However, if the varying views are very close to each other of if the mufti has not been able to decide which of the views is correct and he does not wish to make a conclusion without knowledge and the most that he can do is present the varying views, then he may simply present the views to the one seeking a fatwa without stating which is stronger. The liability [of the mufti] is dependent upon his or her capacity. | لا ينبغي عرض أقوال أهل العلم على المستفتين بدون ترجيح، فإن الذي يسبق إلى وهم المستفتين من هذا المسلك هو الإباحة، إلا إذا كانت المسألة تحتمل ذلك لتقارب الأراء فيها، أو إذا توقف المفتى في الصواب في ذلك فلا يقدم على الجزم بغير علم، وغاية ما يمكنه أن يذكر الخلاف فيها للسائل، والتكليف مناطه القدرة. |
| Concerning Combining Fiqh Schools’ Views and “Juristic Exemptions”“Juristic exemptions” refers to ijtihâds found in fiqh schools that permit a matter while there are other ijtihâds that prohibit the same matter. This is permissible [to follow] if the ijtihâd is considered acceptable. Thus, the ijtihâd must have come from someone capable of performing ijtihâd, there is some need to follow it, and it is not a means to an impermissible goal. Finally, in addition to all the above conditions, the one following such an exemption should also feel at ease with it. | حول التلفيق والرخص الفقهية
الرخص الفقهية ما جاء من الاجتهادات المذهبية مبيحاً لأمر في مقابلة اجتهادات أخرى تحظره، وهو جائز إذا كان الاجتهاد معتبرا، بأن جاء على وجهه ومن أهله، وقامت الحاجة إلى الأخذ به، ولم يكن ذلك ذريعة إلى غرض غير مشروع، وتحققت لدى الآخذ به القدرة على الاختيار، واطمأنت نفسه إلى الأخذ به. |
| It is permissible to combine between the opinions of various fiqh schools when there is a necessity, need, incapacity, or some other valid excuse. This could be done by issuing two fatwas from two madhhabs to one individual concerning two separate issues, or for two individuals each of which will follow a separate school on the same issue, or for one individual on (different details of) one issue as long as it does not lead to fraud or violating the intent of the Lawgiver. | يجوز التلفيق بين المذاهب الفقهية عند الضرورة، أو الحاجة، أو العجز، أو العذر، في مسألتين مختلفتين للشخص نفسه، أو لشخصين كل منهما بمذهب في نفس المسألة، أو للشخص نفسه في المسألة نفسها إذا لم يؤد إلى التطفيف أو مخالفة مقصود الشارع. |
| The prohibited combining of fiqh schools is that which is done out of caprice, what leads to violating a consensus, what nullifies the ruling of a judge, what nullifies what a follower has done concerning one event or what leads to a violation of the intent of the Lawgiver. For example, it would not be permissible for a person to get married without the presence of a guardian or of witnesses and also without announcing the marriage. That would lead to a secret marriage that all are agreed upon is unacceptable. Similarly, fraudulent acts would be impermissible, such as a person invoking the right of preemption for himself when it is in his favor and then denying that right for others when it is against his interests. | التلفيق الممنوع بين المذاهب هو ما كان لمجرد الهوى، أو أدى إلى مخالفة الإجماع، أو نقض حكم القضاء، أو نقض ما عمل به تقليداً في واقعة واحدة، لما يؤدي إليه من مخالفة مقصود الشارع، كمن تزوج بلا ولي ولا شهود ولا إعلان لما يفضي إليه من زواج السر المتفق على رده، أو التطفيف كمن يطالب بالشفعة إذا كانت له، وينكرها إذا كانت عليه. |
| Administrative matters fall into the realm of possible Shareeah options. The ijtihâd concerning it is going to be based on weighing between benefits and harms. The people should consult with each other in a positive fashion and acquiesce to the majority opinion in order to avoid any conflict, as long as that decision does not violate a definite Shareeah ruling. | التراتيب الإدارية تدور في فلك الخيارات المشروعة، والاجتهاد فيها يدور في فلك الموازنة بين المصالح والمفاسد، فيأتمر الناس فيها بينهم بمعروف، والنزول على قرار الأغلبية هو المخرج من فتنتها، ما لم تخالف حكما شرعيا قطعيا. |
| Changes in FatwasA change in fatwas refers to a mujtahid changing his ruling from one to another in order to repel hardship, to fulfill Shareeah benefits, due to the weakness of evidence or due to a change in the nature of the issue as a result of a change in time, place or situation. The final determination concerning such matters will be made by the mujtahid who is well aware of the reality of the situation and what is prescribed concerning it in the sharee’ah. In his ijtihâd, he must also keep in mind the objectives of the Shareeah and the consequences of the actions of the individuals in order to achieve the justice, mercy and perfection of the Shareeah. |

| The default concerning the definitive, affirmed Shareeah rulings is that there is no change to occur to them, as there can be no abrogation of such rulings after the time of the Prophet (peace and blessings of Allah be upon him). When the scholars speak about a change due to changes in time and place, they are speaking about fatwas or rulings in general. | الأصل في الأحكام الشرعية القطعية الثبات وعدم التغير، إذ لا نسخ في الاحكام بعد زمن النبوة، ومن قال من أهل العلم بتغيرها بتغير الزمان والمكان إنما قصد الفتوى، أو الحكم بمعناه العام |
| Fatwas can only change when they are concerning laws that are dependent on comprehensible effective causes, such as those based on interests or customs, when changes occur. Time and place do not in themselves require a change in rulings. | تغير الفتوى يختص بالأحكام المعللة بأمور معقولة المعنى كالمصلحة أو العرف عندما يطرأ عليها التغير، فالزمان والمكان لا يؤثران بذاتهما في تغير الأحكام. |
| A fatwa cannot be considered sound until it takes into consideration the time, place, circumstances, intentions, customs, state and ends. Every fatwa that is based on a legal cause that is related to time, changing benefits, or specific customs will change when its parameters change. A fatwa will not be sound until the state of the one seeking the fatwa, his intent, language and customs of his people are understood. | لا تعتبر الفتوى صحيحة حتى يعتبر فيها الزمان والمكان والأحوال والنيات والأعراف والحال والمآل. وكل فتوى كانت علتها علة زمانية أو مصلحة متغيرة أو عرفا زمانيا فإنها تتغير تبعا لتغير مدركها، ولا تصح الفتوى حتى يعرف حال المستفتي وقصده ولغته وعرف بلده. |
| When the mujtahid is invoking the principles of changing a fatwa, he must never be neglectful of the reality that the Shareeah rulings are constant [by default] and, at the same time, when applying Shareeah rulings to a particular situation, he must not be neglectful of the principles of changing a fatwa [when warranted]. | على المجتهد حين يعمل قاعدة تغيّر الفتوى أن يستبطن معنى ثبات الأحكام الشرعيّة، وحين يُنزل الأحكام الشرعيّة على الواقع أن لا يغفل عن قاعدة تغيّر الفتوى. |
| The principle that a fatwa is to change with time, place and circumstances is a great tool in guiding fatwas and having them remain within the facilitations of the Shareeah and adhering to its commands. | لاعتبار قاعدة تغير الفتوى بتغير الزمان والمكان والأحوال أثر عظيم في ترشيد الفتوى، والإبقاء على استشعار يسر الشريعة والالتزام بأحكامها. |
| The Non-Scholarly Masses and what is incumbent upon them regarding Muftis Holding Divergent ViewsThe non-scholarly individual (layperson) is the one who has not attained enough knowledge of fiqh to guide him in its various matters. As such, it is incumbent upon him to follow those whom he trusts among the muftis. |
حول العامي وما يلزمه عند اختلاف المفتين العامي هو من لم يحصّل من الفقه شيئًا يهتدي به إلى الباقي، ويجب عليه تقليد من يثق بفتواه من المفتين. |
| The layperson does not actually have a school of fiqh. His or her school of fiqh is whatever is given by the mufti. However, they may follow a specific school of fiqh in general in their acts of worship. If that is the case and a new situation arises for which they need a fatwa, it is not mandatory upon them to seek a fatwa from that school that they usually follow. | العامي لا مذهب له، وإنما مذهبه مذهب من أفتاه، ولكن العامي قد يقلد مذهبًا معينًا في جملة تعبده، فإن احتاج أن يستفتي في نازلة، فلا يلزمه طلب مفت من المذهب الذي يقلده. |
| Strictly adhering to a school of fiqh is neither rejected nor required. There is no harm in someone ascribing himself to one of the four fiqh schools and following its Imam. The student of knowledge is advised to study fiqh according to a particular school without zealotry or partisanship. He should choose the school for which there are teachers available and of the books those which provide evidences. Afterwards, he or she should move forward by studying comparative fiqh and the basis of the different Imams approaches until he or she reaches a level of independent research. | التمذهب ليس مرفوضا وليس مفروضا، فلا حرج على من انتسب إلى مذهب من المذاهب الفقهية الأربعة وقلد إمامه، وينصح طالب العلم بدارسة الفقه على الطريقة المذهبية شريطة عدم التعصب، ويختار من المذاهب ما توافر شيوخه، ومن الكتب ما اعتنى بإيراد الأدلة، وأن يترقى بعد ذلك بدارسة الفقه المقارن، والمقابلة بين مدارك الأئمة، حتى يبلغ درجة الاستقلال بالنظر. |
| The state could impose a particular fiqh school upon the muftis and students of knowledge in an exceptional situation in order to avoid the confusion of varying opinions and desires. There is no harm as well in codifying the law and making statutes for the judiciary, so that there will not be conflicting rulings in similar cases and also to make it easier to apply the law from the level of the state. | قد يكون فرض التمذهب من قبل الولاة على المفتين وطلبة العلم مخرجا استثنائيا مرحليا من فتنة تضارب الأهواء والأقوال، ولا حرج في التقنين، ضبطا للمنظومة القضائية، ومنعا لتباين الاحكام في القضايا المتشابهة، وتيسيرا للتعامل بالأحكام الشرعية على المستوى الدولي |
| The one seeking a fatwa must be selective in the choice of a mufti. He or she should take the issue to the one whom they trust of the religious and qualified people. If muftis differ in their verdicts, the laypersons should follow the one whom they believe is giving the ruling of Allah. This can be achieved by following the most knowledgeable and righteous. That can be known through status and reputation. Alternately, they could follow the opinion of the majority if they believe that the truth is with the majority and not with the individuals who differ from that majority view. | ينبغي للمستفتي أن يحسن اختيار مفتيه، فيرفع نازلته إلى من يثق فيه من أهل الديانة والكفاية، فإن اختلفت عليه فتاوى المفتين اتبع من يغلب على ظنه أنه يفتيه بحكم الله، وطريقه إلى ذلك اتباع الأعلم والأورع، ويعرف ذلك بالشيوع والاستفاضة، أو اتباع الجمهور حيث يغلب على ظنه أن الصواب مع الكثرة المجتمعة، وليس مع المخالف لها |
| The majority of the scholars are of the view that it is prohibited to simply follow the easiest view when the muftis differ as that will lead to making the religion based on desires and wants. However, if the muftis seem equal in their religiousness and capabilities and the person does not have the ability to analyze their fatwas and there would be no harm in him following the easier view, then he may do so. | جمهور أهل العلم على المنع من تتبع الأيسر عند اختلاف أقوال المفتين لما يفضي إليه من أخذ الدين بالهوى والتشهي، إلا إذا تساوى لديه أصحابها ديانة وكفاية، ولم يكن لدية أهلية النظر في هذه الأقوال، ولم تترتب على ذلك مفسدة. |
| It is not appropriate for the one seeking a fatwa to jump from mufti to mufti as that could lead to two pitfalls: Being non-compliant with the requirement of submission to Allah by purposely hunting for easier answers, or being subject to severe doubts and confusion that may lead to resenting the worship of His Lord. | لا ينبغي للمستفتي أن يكثر من القفز والتنقل بين المفتين حتى لا يفضي به ذلك إلى التحلل من قيد التكليف بتقصد تتبع الأيسر، أو الوساوس القهرية التي تعنته، وتبغض إليه عبادة ربه عز وجل! |
| A non-scholarly person should not give a fatwa for another person based on what he knows of an issue as he is unaware of the evidence of the mujtahid and there could be differences between the two cases that he is not aware of. However, he can transmit information that he is certain of concerning general rulings concerning which both the masses and people of knowledge are aware of, such as the basic issues of belief, the pillars of the acts of worship, the basics of etiquette, the clearly forbidden and the like. | ليس للعامي أن يفتي غيره في مسألة يعلمها لعدم علمه بدليل المجتهد، ولما قد يكون بين المسألتين من فرق لم يتنبه إليه، إلا أنه قد ينقل إليه ما استيقن من معرفته من الأحكام العامة التي يستوي العامة وأهل العلم في أصل العلم بها، كأمهات العقائد وأركان العبادات وأصول الأخلاق وأصول المحرمات ونحوه. |
| The Fatwa of the HeartThe heart’s fatwa (counsel) concerns an issue for which there is no Shareeah text or the texts are conflicting and a person cannot determine what is correct or some doubt enters into one’s heart, regardless of whether it be concerning the nature of the fatwa itself or in its application and regardless of whether it be concerning the mufti or the one seeking the fatwa. |
حول فتيا القلوب وتكون فيما لم يرد فيه نص شرعي، أو تعارضت فيه النصوص ولم يظهر وجه الحق، أو وردت على القلب بشأنه شبهة، سواء أكانت من جهة الفتوى وتحقيق مناطها، أم من جهة المفتي أو المستفتي. |
| Shaadh (Anomalous) FatwasShaadh Fatwas are those that combine two qualities: They are errant from the truth and contradict the 129 views the people (community of scholars)! That is, they contradict an authentic text or a clear consensus.
A mufti can avoid making shaadh fatwas by not being hasty, consulting with others, being cautious in fatwa giving, establishing group ijtihâds or by simply saying, “I don’t know.” |
حول الشذوذ في الفتوى الفتوى الشاذة هي ما اجتمع فيها أمران ؛ مجانبة الحق ومخالفة الخلق! فهي التي تعارض النص الصحيح، أو تخالف الإجماع الصريح. من أعظم الأسباب المانعة من الشذوذ في الفتوى عدم التعجل، والمشاورة، والتورع عن الفتوى، و تفعيل الاجتهاد الجماعي، وقول لا أدري. |
| Group ijtihâds, like those found in the fiqh assemblies and fiqh councils, are more likely to reach the correct conclusion. Thus, one must resort to them as much as possible, especially in the new issues or those issues that afflict the masses as a whole. However, such group ijithaads are not definitive evidence and it is not mandatory that everyone follow them. | الاجتهاد الجماعي والذي يتمثل في فتاوى المجامع الفقهية ولجان الفتوى أقرب إلى الصواب، فينبغي أن يصار إليه ما أمكن، لا سيما في النوازل أو المسائل العامة التي تتعلق بعموم الناس، وإن كان ليس بحجة قاطعة، ولا يلزم اتباعه على كل أحد . |
| Fatwas via Live MediaFatwas via television and live media have some positive and some negative aspects to them.
The positive aspects include: the ease of getting a fatwa, the spreading of religious knowledge among the people, strengthening the unity of the Muslim Ummah, making it easier for the members of the Ummah and its scholars to connect with one another, making it such that the scholars can become known and increase their influence in the society without them having to travel from place to place. This is all in addition to the access the scholars and Islamic workers have in getting knowledge of the affairs of the Muslims and what they are facing of challenges and problems in various parts of the world. |

| The negative aspects include conflicting fatwas on very similar issues that leads to confusion and chaos, the spreading of shaadh opinions among the people, propagating of heretical ideas and mistaken fatwas, lack of taking into consideration the circumstances of each particular land and society, and distancing the people from actually having direct contact with the scholars. With respect to television in particular, the details of the ruling are not sufficiently presented due to time restrictions. Furthermore, governments often control the media and steer the contemporary fatwas according to their wants and desires. | ومن مساوئه: تعارض بعض الفتاوى في المسائل المتجانسة وما يفضي إليه ذلك من البلبلة والحيرة، وانتشار فتاوى شاذة بين الناس، والترويج لأفكار بدعية وفتاوى ضالة، وعدم مراعاة أحوال كل بلد وظروف كل مجتمع، وقطع الناس عن التواصل الحقيقي المباشر مع العلماء، وبالنسبة للتلفاز خاصة عدم بيان الحكم الشرعي في القضايا المسئول عنها بشكل كاف ودقيق بسبب ضيق زمن البرنامج، وتسلط الحكام والمسؤولين فيه على الفتوى المعاصرة حسب الرغبات والأهواء. |
| The positives of such connectivity are greater than the negatives. Therefore, the scholars, students of knowledge and Islamic workers should seek to use these modern means of communication while limiting their downside to the best they can. | حسنات التواصل عن بعد في عالم الفتيا أعظم من مساوئه، ولذا ينبغي حث العلماء وطلبة العلم و الدعاة على استخدام وسائل التواصل الحديثة و تقليل مساوئها قدر المستطاع، وذلك بأن تحال القضايا التي تحتاج إلى استفصال إلى التواصل المباشر مع المفتي. |
